3. Privacy Notice for Job Applicants


Compliance with data protection regulations is a top priority for us. Below, we would like to inform you about the collection and processing of your personal data:



Data Controller: The entity responsible for data processing is WasteAnt GmbH, Konsul-Smidt-Str. 8e, 28217 Bremen, office@wasteant.com.


Purpose and Legal Basis of Data Processing: We process your personal data for the purpose of deciding whether to establish an employment relationship. As part of the application process, we process your personal data, in particular your contact information, such as your name and address, as well as all data related to your application, such as your resume, references, and qualifications. If you submit a request for reimbursement of travel expenses, we will also need your bank account information. The legal basis for the processing of your data is derived from Article 88 of the GDPR in conjunction with Section 26(1) sentence 1 of the BDSG or Article 6(1) sentence 1(b) of the GDPR.


In addition, we collect and process personal data that you voluntarily provide to us. The processing of this data is based on your revocable consent pursuant to Article 6(1)(a) and Article 7 of the GDPR in conjunction with Section 26(2) of the BDSG.


Talent Pool: If we have not hired you but are still interested in your application, we may ask if we may keep your application on file for future job openings. This extended retention is based on your revocable consent pursuant to Art. 6(1)(a) and Art. 7 of the GDPR in conjunction with § 26(2) of the BDSG. Inclusion in our talent pool is voluntary, and failure to provide the relevant consent has no effect on other ongoing application processes.


Recipients of your data: We naturally treat your data as confidential and do not transfer it to third parties. Where necessary, we engage service providers who are strictly bound by our instructions and who support us, for example, in the areas of IT or the archiving and destruction of documents, and with whom separate contracts for data processing have been concluded. We do not transfer your data to locations outside the EU or the EEA.


Retention period/criteria for determining the retention period: Unless a statutory retention period applies, data will be deleted as soon as storage is no longer necessary or the legitimate interest in storing the data has ceased to exist. If you are not hired, this typically occurs no later than three months after the conclusion of the application process or after receipt of the rejection notice. We also delete data if you withdraw your consent to the processing of your data.


We store applications that we have added to our talent pool for one year. After that, the documents are deleted. We retain your declaration of consent for inclusion in our talent pool for an additional three years to comply with our accountability obligations under Article 5(2) of the GDPR. In individual cases, certain data may be stored for a longer period (e.g., travel expense reports). The duration of storage is then determined by statutory retention requirements, such as those under the German Fiscal Code (6 years) or the German Commercial Code (10 years). Further storage of your data is also permitted if, following a balancing of interests, further processing is necessary for us to assert, exercise, or defend legal claims.


Automated decision-making: Since the decision regarding your employment relationship is not based solely on automated processing, no automated decision is made in individual cases within the meaning of Article 22 of the GDPR.


Your data protection rights: You have the right to request, free of charge, information about the personal data stored about you (Article 15(1) of the GDPR). In addition, provided the legal requirements are met, you have the right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), and restriction of processing (Art. 18 GDPR) of your personal data, as well as the right to data portability (Art. 20 GDPR). You have the right to withdraw your consent at any time with future effect if the data is processed on the basis of Art. 6(1)(a) or Art. 9(2)(a) of the GDPR. You have the right to object to the processing of your data pursuant to Art. 21 GDPR if the data is processed on the basis of Art. 6(1)(e) or (f) GDPR.
